Biography

Marc Wintgens (1961) has plenty of experience in the field of private construction and real-estate law, with a special focus on complex matters involving both government parties and private-law parties. He is active in development, construction, infrastructure, real estate and energy. Marc is regarded as one of the best specialists in his field, a reputation confirmed by international rankings such as “Chambers” and “Legal 500”, while in the past his professional peers ranked him among the top three of the best real-estate lawyers in the Netherlands.

Marc has authored a range of relevant publications in this field and he published the legal handbook for transformation of real estate. Transformation and renovation have become standard in the Netherlands for transactions and developments. Furthermore Marc was one of the co-authors of a  handbook on renovation and transformation of real estate, covering not only legal, but also, inter alia, tax, finance and accountancy. This year , a new book authored by Marc Wintgens  has been published. This book is titled: ‘Transformation and Renovation of Real Estate’.

Marc is also lecturer Construction and Real Estate Law at the Amsterdam University (VU) and the Utrecht University. Marc is also a member of the Construction Law Association, the Construction Lawyers Association and the Real-Estate Society. 

Recent transactional highlights
  • Advises largest (re)development in the Netherlands 

Marc Wintgens and his team are doing all legal work with respect to the largest (re)development in the Netherlands, Strijp S, comprising around 450,000 sqm on a former Philips Electronics site. Our team is advising VolkerWessels, the second largest construction company in the Netherlands, the PPP Company (Park Strijp CV) and the Municipality of Eindhoven and is involved in almost all legal transactions and issues associated with the project. Strijp S is the largest development project in the Netherlands. Furthermore, it is one of the first projects in which transformation-/renovation is as important as the construction of new real estate. It is one of the most complex developments in the Netherlands, while the timeframe involved is very long (approximately 25 years). Last year the Railway Area has been taken in to development including the conclusion of major transactions with inter alia ING and Amvest.

  • Advises largest hospital in the Netherlands

Marc Wintgens leads the team that advises and supports the client Erasmus MC in Rotterdam (the largest hospital of the Netherlands) on all legal aspects of the renovation and new construction of the Eread Building (more than 100,000 sqm.) and the Sophia Hospital. The time frame of the project is approximately 12 years. It is a very complex (re)development. During the development and construction activities, the normal activities (research and health care) within these buildings will continue. This has an enormous impact on the planning, the construction-method and the risks for the contractor, the principal and the insurer. Furthermore, the development / construction process will take approx. 10 years.
