With over fifteen years of legal experience, he has played a key advisory role in major infrastructure and energy projects, including geothermal, wind, and solar power developments, as well as significant public-private partnership initiatives involving government institutions and public universities. His work also includes advising on privatization processes, special economic zones, and large-scale construction projects structured under internationally recognized contract frameworks such as FIDIC.

- Bernard advised African Export-Import Bank in connection with a USD 80.5 million financing facility provided to a Kenyan power company for the indirect acquisition of Iberafrica Power
(E.A.) Limited and Thika Power Limited. These companies operate thermal power plants with a combined capacity of approximately 140MW. Bernard advised the lender on legal, regulatory and commercial aspects of the transaction, including reviewing the PPAs and assessing the historical performance and capacity of the assets to generate sufficient cashflows to service the facility. The transaction enabled the successful acquisition of the assets while ensuring that the financing structure was robust and bankable. - Bernard advised Nexus Green Limited, a UK-based renewable energy company, in the acquisition of the assets of Hannan Arya Energy (K) Limited, a Kenyan power generation company.
Acting for the acquirer, Bernard led the legal aspects of the transaction, including negotiating the asset purchase, novation of the power purchase agreement and transfer of licences, approvals and authorisations required for continued project operation. The transaction enabled Nexus Green to expand its clean energy footprint in East Africa while ensuring continuity of the project’s contractual and regulatory framework. - Bernard advised Kaishan Renewable Energy Development Pte Ltd on its investment in a geothermal power project in Kenya.
His work included advising on the acquisition of shares in the project company, negotiating the geothermal exploration licence with the Ministry of Energy and Petroleum and supporting stakeholder engagements with local communities. Bernard also advised on negotiations with regulators and the project off-taker, Kenya Power and Lighting Company. The engagement required navigating Kenya’s regulatory framework for geothermal development and coordinating multiple stakeholders to support the project’s successful implementation.
