Macau: Construction sector accreditation

On January 5 2015, the Official Gazette published Law 1/2015, which provides for the new legal regime on the system of qualifications in the fields of urban construction and urbanism.

This new law will come into force on July 1 2015 and was enacted as a response to the tremendous growth that Macau SAR has been facing in the civil construction and urbanism sectors.

The main purpose of the Law is to establish a new system related to the professional qualification and the registration of professionals that perform tasks in civil construction and urbanism, as the existing regime is undemanding in terms of the qualification of technicians that wish to draft projects and lead construction works.

The Law on the urban construction and urbanism establishes the creation of the Council of Architecture and Engineering. The Council will be competent to conduct the accreditation and registration of graduates in architecture, landscape architecture, urban planning and engineering that wish to obtain the professional title.

Under this regime, the professional qualification of said graduates should be acquired through the accreditation and registration with the Council of Architecture and Engineering. The performance of certain duties, including drafting projects, leading construction works and supervising construction works, will be further subject to a registration with the Land, Public Works and Transport Bureau. The registered technicians will then participate in continuous training.

The accreditation procedure requires a degree in architecture, landscape architecture, urban planning and engineering, a traineeship for a period of two years on a full-time basis or five years part-time and approval through an admission exam. Further, the applicants must be Macau residents.

The Land, Public Works and Transport Bureau will be competent to supervise compliance with this regime and to initiate the procedure for applying the provided sanctions.

We are of the view that this system will enrich these professions. The system will increase the requisites to perform such activities, thereby enhancing the quality of construction works in the Macau SAR.
