China’s first cartel case endorses tiered penalties

China’s National Development and Reform Commission (NDRC) has concluded its first investigation into price fixing since the enactment of the Anti-Monopoly Law, indicating the authority’s attitude to leniency for cartel participants.

Following an investigation into price fixing by 33 rice noodle producers in Guangxi, NDRC issued tiered penalties, punishing the three alleged organisers with a RMB100,000 ($15,000) fine, 18 participants with fines ranging from RMB30,000 to RMB80,000 and 12 other participants with a warning.
