Pre-merger approval coming to Indonesia

Despite a competition law that requires post-merger filings, Indonesia is set to introduce mandatory pre-clearance.

The new regulation, which would give the Business Competition Supervisory Commission (KPPU) 30 days to review a merger before it can close, is reportedly awaiting the president’s signature.

But such a regulation would contradict Indonesia’s 1999 Anti-monopoly Law which requires a merger...
